INDUSTRY NEWS: PERMITTED DEVELOPMENT REGULATIONS UPDATED FOR CHANGE OF USE TO DWELLINGS
National Legislation currently sets out Permitted Development (PD) rights which allow buildings in Storage / Distribution use to be converted to Residential without requiring full planning permission to first be sought.
In 2018 the government announced an extension to these temporary PD rights. This extension requires the Local Planning Authorities’ prior approval to have been gained before 10th June 2019.
At the same time a one-year extension was also announced, for temporary PD rights allowing the conversion of storage and distribution uses to housing to include any cases where prior approval has been gained before 10th June 2019.
In order to receive a prior approval consent, a number of criteria must be met, such as the building being in storage and distribution use on or before 19th March 2014. Other topics must also be addressed, such as proposals impact on air quality, transport and highways, contamination risks, flooding risks, noise impact, and impact on the sustainability of adjoining uses. While these can often seem like insurmountable obstacles, with the right team of professionals to assist you, prior approval can be achieved.
For a property to benefit from these PD rights, the prior approval date (not submission) must be before 10th June 2019. The development must then be completed within three years of the approval.
